The training your employer owes you (Law 31/1995, article 19)
- Theoretical and practical, sufficient and adequate, when you are hired and when your duties or your equipment change, focused on your job and repeated if necessary.
- Within working hours whenever possible and at no cost to the worker.
Appointing someone preventive resource does not replace that training: the law also asks for the basic level (module 2).
What is up to you as a worker (article 29)
- Look after, as far as you can, your own safety and that of the people affected by your work, following your training and the employer's instructions.
- Use machines, tools and substances correctly, as well as the protective equipment provided.
- Do not disable safety devices.
- Report immediately any situation involving risk.
- Cooperate with the employer so that safe conditions can be guaranteed.
When the preventive resource gives an instruction, it is exercising the monitoring the law entrusts to it; following it is part of these obligations.
The limit: the preventive resource is not a «quick fix»
The presence of preventive resources does not relieve the employer of any other protection duty (Royal Decree 39/1997, article 22 bis.10): assessing risks, planning, providing equipment and training, monitoring health. A preventive resource with no measures to monitor does not comply with the rules.
